Disability Claims Process: An Overview

Individuals who are suffering from a physical or mental impairment and are unable to be gainfully employed may be entitled to Social Security disability benefits. The disability claims process is complicated. But with the guidance and assistance of a Sugar Land disability attorney, you will have an easier time applying for and actually getting the disability benefits you deserve.

Initial Application

The first step in filing for Social Security disability is to complete an application. Your Sugar Land disability attorney can help you file your application in one of four ways:

2. By mail

3. Online, by visiting www.socialsecurity.gove/applyfordisability/adult.htm

4. In person at a local Social Security office

If you decide to apply by phone or in person, you will need to go through an interview process with the Social Security Administration (SSA) personnel. At your interview, you need to provide basic information and a description of your physical or mental disability. The SSA personnel will enter the information you provide into a computer application form. You will receive a printed copy in the mail, which you will have to sign and return.

In order to prevent any delays in the process of your application, you should have your Sugar Land disability attorney review the application for any mistakes prior to signing and returning it to the SSA.

The signed application will be reviewed and processed by your local SSA field offices and state agencies. Less than 30 percent of all claims at this initial stage are approved, prompting the majority of claimants to appeal their claim.

Reconsideration

The first level of appeal in the disability process is called reconsideration. This level is similar to the initial process in that the same SSA team reviews your application and makes the reconsideration determination. The majority of appeals are also denied at this level.

Administrative Law Hearing

The next level of appeal is called the administrative law hearing. Your appeal will be heard before an administrative law judge. Generally, claimants have the highest rate of success at this level.
